Dispute Resolution and Court Litigation

Disputes come in a variety of types and sizes, including commercial disputes between parties, a dispute with a government authority about one of its decisions or disputes between partners and shareholders of a business or some form of property.

Dispute Resolution

CK Lawyers’ dispute resolution services provide expert legal assistance to those who seek to resolve their disputes quickly and cost-effectively through negotiation, mediation, conciliation and arbitration. These processes can be employed to resolve disputes without going to court. These processes involve each party voluntarily agreeing to a settlement.

There are advantages and disadvantages to each type of dispute resolution process. CK Lawyers knows which is best suited to which situation and will be able to advise you accordingly.

The CK Lawyers legal team can also act behalf of clients who face compulsory conciliation conferences and mediations ordered by the court, which act as an attempt to settle matters before court hears the dispute formally with calling of evidence, examination, cross examination etc.

Over recent years Arbitration, which is a process whereby each party presents their case to an expert third party arbitrator who decides on the dispute, has become a popular means of resolving a dispute between parties and we at CK Lawyers are best suited to assist, advise and represent you in this process.

Litigation

CK Lawyers can provide legal advice regarding the submission of the dispute to the relevant court, and represent clients in court. Litigation occurs when a matter is presented to a third-person, usually a judge in a local, district, Supreme or High Court or a tribunal member for example the NSW Civil and administrative tribunal; The judge or the member can then impose a decision that resolves a legal dispute. Litigation is highly technical and often expensive and will take a long time.

Other forms of dispute resolution, arbitration for example, are less costly, quicker, and the decisions are private. Matters decided through litigation are public.
